(the “Site”), including all content, features, software, data, text, images, video, and other materials made available through the Site (collectively, the “Content”). By accessing or using the Site you agree to these T&Cs. If you do not agree, do not use the Site.
MightyMen Webcrafters (“MightyMen,” “we,” “us,” or “our”) grants you a limited, non-exclusive, revocable license to access and use the Site subject to these T&Cs. If you are accepting these T&Cs on behalf of an organization, you represent and warrant you have authority to bind that organization to these T&Cs.
We may modify these T&Cs at any time by posting the modified terms on the Site with a revised Effective Date. It is your responsibility to review the T&Cs periodically. Continued use of the Site after changes are posted constitutes acceptance of the revised T&Cs.
You may use the Site only for lawful, personal or business browsing, research, and evaluation of MightyMen’s services. You must not:

• Upload or transmit any content that is unlawful, infringing, defamatory, abusive, obscene, harmful, or that violates any person’s privacy or publicity rights.
MightyMen reserves the right to restrict, suspend, or terminate access to the Site for any misuse or violation of these T&Cs.
All intellectual property rights in the Site and Content (including copyrights, trademarks, trade dress, and database rights) are owned by MightyMen or its licensors. Nothing in these T&Cs grants you any right or license to use MightyMen’s trademarks, logos, domain names or other proprietary marks without our prior written consent.
If you post or submit any materials to the Site (including comments, messages, case studies, testimonials, or files — collectively “User Content”), you grant MightyMen a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, copy, modify, publish, distribute and display that User Content on the Site and in MightyMen marketing materials. You represent and warrant that you own or have the necessary rights to grant this license and that your User Content does not violate any law or third-party right.
We are not obligated to monitor User Content but may remove or modify any User Content at our discretion.
You are responsible for backing up and securing any User Content you submit. MightyMen is not liable for loss, corruption, or unauthorized access to User Content except to the extent caused by MightyMen’s gross negligence or willful misconduct.

THE SITE AND CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. MIGHTYMEN DISCLAIMS ALL REPRESENTATIONS AND WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. MIGHTYMEN DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MIGHTYMEN WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOSS OF DATA, OR LOSS OF BUSINESS, ARISING OUT OF OR RELATED TO YOUR ACCESS TO OR USE OF THE SITE OR CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
MIGHTYMEN’S AGGREGATE LIABILITY FOR DIRECT DAMAGES ARISING FROM OR RELATED TO THESE T&CS WILL NOT EXCEED ONE HUNDRED CANADIAN DOLLARS (CAD $100) OR THE AMOUNT YOU HAVE PAID MIGHTYMEN FOR SERVICES IN THE PRIOR 12 MONTHS, WHICHEVER IS GREATER, TO THE EXTENT PERMITTED BY LAW.
Some jurisdictions do not permit limitation of liability or exclusion of certain damages; where such laws apply, MIGHTYMEN’S LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
MightyMen may suspend or terminate access to the Site at any time, with or without cause, and without notice. Upon termination you must stop using the Site and delete any copies of Content you have made where required.
You agree to indemnify, defend, and hold MightyMen and its officers, directors, employees, agents and affiliates harmless from and against any claims, liabilities, losses, damages, costs, and expenses (including reasonable legal fees) arising from your breach of these T&Cs, violation of any law, or infringement of any third-party rights.

These T&Cs are governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles. You and MightyMen submit to the exclusive jurisdiction of the courts of British Columbia for any dispute arising under these T&Cs. To the extent permitted by law, you and MightyMen each waive the right to trial by jury.
• Severability. If any provision of these T&Cs is invalid or unenforceable, the remainder will remain in full force.
• No waiver. Failure to enforce any provision will not constitute a waiver.
• Assignment. You may not assign these T&Cs without MightyMen’s prior written consent. MightyMen may assign these T&Cs in connection with a sale or transfer of assets.
• Entire Agreement. These T&Cs and our Privacy Policy constitute the entire agreement regarding your use of the Site.
